According to the Justice Ministry’s outline of a bill to revise the Civil Code, the current six-month (180-day) ban on the remarriage of women will be shortened will be shortened to 100 days and the immediate remarriage of women who are not pregnant when they are divorced will be permitted.
法務省の民法改正案の概要によると、現在は6か月(180日)とされている女性の再婚禁止期間が100日間に短縮されるとともに、離婚時に妊娠していない女性の再婚は直ちに認められることになる。
The top court’s Grand Bench ruled that the part of the six-month remarriage ban for women that extends beyond 100 days has become an excessive restriction as there would not arise such confusion as to who is the father of an expected child, with the passage of 100 days from divorce.
最高裁大法廷が示した判断によると、女性に対する6か月の再婚禁止期間のうち100日を超える部分は、離婚後100日が過ぎれば、生まれる子の父親が誰かの混乱は生じないので、過剰な制約になっている。
