Recipient shall have no obligation to preserve the proprietary nature of any Information if said party can document that such Information is or becomes publicly available by means other than breach of the Recipient’s obligations under this Agreement.
当該情報が受領者の本契約上の義務に違反しない手段で公然と入手できることまたは入手できるようになったことを、上記当事者が文書で証明できる場合には、受領者に本情報の専有性を保持する義務はないものとする。
